Export control regulations

The implementation of training sessions / events as well as any other type of knowledge transfer (hereinafter jointly referred to as “Knowledge Transfer”) is subject to the applicable export control regulations. All companies of the CADFEM Group, regardless of their registered office, take into account in particular the export control regulations of the Federal Republic of Germany and the European Union. For the implementation of Knowledge Transfer in connection with Ansys software or software based on it, the (re)export control regulations of the USA also apply due to the U.S. origin of this software. To ensure compliance with the aforementioned provisions, we ask on the basis of the information available to you as a participant (m/f/d) and/or applicant (m/f/d) as well as in your company to confirm that:

  1. The registered participant (m/f/d) is not domiciled (according to the registered/known address) or permanently resident in an EU-Embargo country, will not be present in an EU-Embargo country during the Knowledge Transfer and/or will not use information, documents and also software products transmitted or made available during the Knowledge Transfer or in connection with the Knowledge Transfer in an EU-Embargo country. For the purposes of this Confirmation, EU embargoed countries are those listed at www.sanctionsmap.eu, with the exception of countries affected solely by personal financial sanctions.
     
  2. The registered participant (m/f/d) will not be in the region of Crimea/Sevastopol, Donetsk, Luhansk and Zaporizhia or in the countries of Belarus, Russia, Cuba, Iran, North Korea or Syria during the knowledge transfer.
     
  3. The registered participant (m/f/d) is not a government member or employee of the Crimea/Sevastopol, Donetsk, Luhansk and Zaporizhia region or the countries Belarus, Russia, Cuba, Iran, North Korea or Syria.
     
  4. The registered participant (m/f/d) is not a citizen (m/f/d) of the countries Russia, Cuba, North Korea or Syria. Note: Citizens (m/f/d) of Russia, Cuba, North Korea or Syria who either (1) hold a second citizenship of a country that is not subject to a U.S. embargo (e.g. Germany) or (2) have the status of permanent residence ("Green Card" or equivalent status of permanent residence and work) in a country that is not subject to a U.S. embargo (e.g. Germany) are not considered, for the purposes of this Declaration, as a citizen (m/f/d) of the countries of Russia, Cuba, North Korea or Syria.
     
  5. Information, documents and also software products provided during the Knowledge Transfer or in connection with the Knowledge Transfer are not used by the registered participant (m/f/d) for any prohibited use or use requiring approval. This includes in particular, regardless of the place of use, any use in connection with:
    - nuclear, chemical or biological weapons or carrier systems (missiles, unmanned aerial vehicles) and their deployment,
    - other military end uses,
    - (civil) nuclear facilities,
    - communication/data monitoring regarding natural persons,
    - intelligence end uses.
